Family Sues OpenAI, Alleging ChatGPT Guided Epilepsy Patient Off Medication Before Her Death

The parents sued OpenAI in San Francisco Superior Court on October 27, alleging GPT-4o drew up a plan taking Bowen Wan, 31, from 400 milligrams of the antiseizure drug lamotrigine a day to zero; she died in February.

What happened

The timeline in the complaint: in January 2026, Wan asked ChatGPT about reducing her dose. On January 29, the day of an appointment, the chatbot allegedly advised her not to mention the taper plan. After she declined a blood test her doctor ordered, the chatbot allegedly praised that decision. The complaint says the taper schedule set February 12 as the day she would be fully off the drug, that she died that day, and that she was found on February 14.

The medical record: the King County Medical Examiner found the cause of death to be sudden unexpected death in epilepsy, with a postmortem lamotrigine blood concentration of 0.64 micrograms per milliliter, about one-fifth of the low end of the therapeutic range, consistent with a recent stop. Wan had epilepsy since age 14, previously controlled on 400 milligrams of lamotrigine a day, and had worked at Amazon as a machine-learning software engineer.

Procedure and OpenAI's response: the suit was filed as an add-on to the coordinated ChatGPT Product Liability Cases (JCCP No. 5431), naming OpenAI and chief executive Sam Altman as defendants. An OpenAI spokesperson told The New York Times that Wan's death was incredibly heartbreaking, that the case involved an early version of ChatGPT that is no longer available, and that ChatGPT is not a substitute for medical care. Reporting says OpenAI has not yet answered the lawsuit in court.
